Birmingham Hip Resurfacing Lawsuits. Rosetta Ventimiglia from Michigan recently filed a product liability and personal injury claim against Smith & Nephew.
According to Ventimiglia, the premature failure of the Birmingham Hip Resurfacing (BHR) metal hip device lead her to develop severe metal blood poisoning. Ventimiglia had to undergo painful and risky revision surgery less than three years after the metal hip was implanted.
Ventimiglia succumbed to metallosis from the Birmingham Hip Resurfacing implant after metal fragments were released during the normal grinding action between the cup and metal head.
According to her lawsuit, Ventimiglia was implanted with a Smith & Nephew Birmingham implant in 2014, as part of a right hip resurfacing procedure. She complained about severe hip pain, reduced motion, as well as “clunking” and “locking” sensations in her right hip shortly after the hip implant surgery.
Upon further investigation by her doctors, she was found to have increased levels of cobalt and chromium in her blood and tissue destruction around the hip implant. She was diagnosed with premature failure of Birmingham hip implant and she had to undergo surgery to remove the implant.
Smith & Nephew Birmingham Hip Resurfacing FDA Approved
The FDA approved the BHR hip implant in May 2006, requiring Smith & Nephew to meet post-marketing surveillance and reporting requirements designed to ensure that in real-world use, the hip replacement system was safe and effective. But, Ventimiglia’s lawsuit alleges that the company failed to do so.
Smith & Nephew Birmingham Hip Resurfacing Multidistrict Litigation
Many Smith & Nephew Birmingham Hip Resurfacing lawsuits have been filed nationwide, alleging that the metal hip system was defective and unreasonably dangerous, leading patients to develop metallosis and premature failures.
In April, the U.S. Judicial Panel on Multidistrict Litigation (JPML) agreed that all Birmingham Hip Resurfacing cases be centralized and consolidated for pre-trial discovery before U.S. District Judge Catherine C. Blake in the District of Maryland.

I had both hips replaced, the right in 2009 and the left in 2010. I was going to have my left hip replaced in 2013 but my heart went into afib and surgery was postponed until 2014. It had started squeaking and catching. We found out I had high
levels of metal in my blood. It was extremely painful. My metal hip was replaced with a ceramic hip in 2014. I still have one metal hip and get bloodwork done every 6 months. I think about my metal hip every day and wonder when it will fail me and I will have to have another hip replacement.We talked to attorneys before and they said Smith & Nephew were federally exempt from any lawsuits.My name Tim Scoggins and I can be reached at 217-753-1604. I sent my medical records to you several years ago and never heard anything more. I had a right hip resurfacing in Aug 2010 and had to have a THR on the same side in December 2013. I want in on a class action suit and am so happy to see that Smith and Nephew may end up taking responsibility to all that they hurt, including me!
