As a Texas medical doctor and Biomet M2A-Magnum hip metallosis injury and replacement attorney I am providing this timely update for folks who have been injured by defective metal-on-metal hip replacement implants.



Biomet M2A-Magnum MDL Authorized

All filed federal Biomet M2A-Magnum hip replacement lawsuits will be transferred to the Northern District of Indiana for coordinated pretrial proceedings as part of an MDL, or multidistrict litigation. The U.S. Judicial Panel on multidistrict Litigation (JPML) on October 2 issued an order creating the MDL.

Biomet M2A-Magnum Lawsuits

The plaintiffs allege that the defective design of the Biomet Magnum metal-on-metal hip replacement unit causes the component parts to grind against each other, leading to a severe medical condition known as metallosis. Metallosis is where metal fragments are absorbed locally into the hip joint causing inflammation and descrution of the hip joint. The metal components particularly Cobalt and Chromium ions can be absorbed into the blood stream. Metallosis may increase the risk of loosening or failure of the implant.

Biomet Magnum MDL and Other Metal-on-Metal Hip MDLs

Three other MDLs have been created involving metal-on-metal hip replacement problems, including the DePuy ASR hip, DePuy Pinnacle hip and Wright Conserve hip.

What is a MDL?

The creation of a MDL means that all lawsuits filed in federal court will be consolidated for pre-trial proceedings. But if the parties fail to reach a settlement, the cases will be remanded back to their districts of origin and be resolved through individual trials.

Panel Chose Northern Indiana For Biomet Hip Litigation

The JPML noted that nobody had requested the Indiana location and that no cases had been filed there. The court admitted that the proximity to Biomet’s Warsaw, Indiana headquarters as the major reason for the decision.
